Terms of Use – EZ Smart Courses

Please read these Terms of Use carefully before using EZ Smart Courses.

These Terms govern access to and use of EZ Smart Courses, a course and community management system designed to operate as a plugin for WordPress websites.

EZ Smart Courses is operated by Shahar Dahan, an Israeli exempt dealer (Osek Patur), operating commercially under the name “Ezili.”

By using the system, you agree to these Terms of Use. If you do not agree to these Terms, you should not use the system.

1. About EZ Smart Courses

EZ Smart Courses is a software system that enables WordPress website owners to create and manage courses, lessons and educational content, students and users, communities, communications, calendars, tasks, exercises, and other tools related to the learning and community experience.

Certain features may depend on third-party services, WordPress, hosting providers, other plugins, external services, and technologies that are not operated directly by EZ Smart Courses.

2. Website Owners and End Users

A website owner may use EZ Smart Courses to provide courses, operate communities, deliver educational services, and offer additional services to students and users of their website.

The website owner is responsible, among other things, for:

• The courses and services offered through their website.
• The content they upload or make available to users.
• Managing access for students and users.
• Communications and the commercial relationship between the website owner and their users.
• Compliance with laws applicable to their business, courses, products, and services.
• Providing applicable terms, cancellation policies, refund policies, and other information required in connection with services they sell.

EZ Smart Courses provides the software and tools and does not, solely by virtue of use of the system, become a party to the contractual relationship between a website owner and their students or customers.

3. User Accounts and Access

Some system features may require a registered user account.

Users are responsible for safeguarding their login credentials and for activity carried out through their account.

You may not:

• Use another person's account without authorization.
• Share access credentials in violation of applicable permissions.
• Attempt to bypass authorization or security mechanisms.
• Attempt to obtain unauthorized access to the system, accounts, or information.
• Disrupt or interfere with the proper operation of the system.

Access to particular courses, communities, or features may depend on permissions established by the relevant website owner.

4. Acceptable Use

EZ Smart Courses may only be used for lawful purposes.

You may not use the system to:

• Commit fraud or deception.
• Harass, threaten, impersonate, or harm another person.
• Publish or distribute unlawful content.
• Upload malicious software, harmful code, or files intended to damage the system.
• Attempt to compromise the security of the system or another user's account.
• Collect information about users without appropriate authorization.
• Circumvent access restrictions or permissions.
• Use the system in a manner that may materially interfere with its operation or the experience of other users.
• Infringe copyrights, trademarks, privacy rights, or other rights of third parties.

Website owners may establish additional rules that apply to the courses and communities they operate.

5. Courses and Educational Content

Website owners and course creators are responsible for the educational content they publish through EZ Smart Courses.

EZ Smart Courses does not independently review and does not guarantee the accuracy, completeness, quality, effectiveness, or suitability of course content published by website owners.

Educational content displayed through a website using EZ Smart Courses does not by itself constitute professional, medical, legal, financial, or other regulated advice unless the relevant service provider expressly presents it as such and is legally authorized to provide such advice.

6. User Content

The system may allow users and website owners to upload, publish, or send content such as videos, images, files, exercises and assignments, messages, comments, community posts, links, and educational materials.

Your content remains yours.

Uploading content to EZ Smart Courses does not transfer ownership of that content to us.

By uploading content through the system, the user grants the permissions reasonably necessary to store, process, display, transmit, and operate that content as required to provide the functionality requested by the user.

The user represents that they have the rights and permissions necessary to upload and use the content.

Users may not upload content that infringes copyrights, privacy rights, trademarks, or other rights of third parties.

7. Communities and Communications

EZ Smart Courses may include community areas, groups, private conversations, messages, comments, and other communication tools.

Users are responsible for the content they publish or send. Content published in a shared or community area may be visible to other users who have access to that area.

Website owners and authorized administrators may manage and moderate content on their website, including removing content or restricting access where appropriate.

Access to content or specific features may be restricted where reasonably necessary for security, legal compliance, system integrity, or prevention of misuse.

8. Exercises, Videos, and Media

The system may allow users to record, upload, store, and share exercises, videos, images, and other media.

Users are responsible for ensuring that they have appropriate permission to record, upload, or share people, music, works, materials, or other information appearing in content they submit.

Where the system allows the creator of content to delete that content or revoke access to it, other users may lose access to content that was previously shared with them.

9. Calendar and Google Calendar

EZ Smart Courses includes an internal calendar related to learning activity.

Users may choose to connect their Google account in order to synchronize eligible events and tasks from EZ Smart Courses to Google Calendar.

The connection is optional and is established only after the user chooses to connect their account and approves the required permissions through Google. Users may disconnect the integration at any time.

Use of Google Calendar is also subject to Google's applicable terms and policies. EZ Smart Courses cannot guarantee the continuous availability or proper operation of Google Calendar or other external services outside its control.

10. Third-Party Services

EZ Smart Courses may operate in combination with third-party products and services, including WordPress, hosting providers, video services, Google services, and other external tools.

Use of such services may be subject to the terms and privacy policies of the relevant providers.

EZ Smart Courses is not responsible for changes, restrictions, interruptions, or failures originating from third-party services that are outside its reasonable control.

11. Intellectual Property

EZ Smart Courses, including its software, code, interface, design, branding, documentation, and original components, is protected under applicable intellectual property laws.

Unless expressly authorized, you may not:

• Copy or distribute the software.
• Reverse engineer protected components, except to the extent expressly permitted by law.
• Remove copyright, ownership, or proprietary notices.
• Represent EZ Smart Courses or its branding as software owned by you.
• Redistribute or commercially exploit the plugin outside the rights granted under the applicable license.

These Terms do not transfer ownership of EZ Smart Courses intellectual property to the user.

12. Feedback and Suggestions

Users may provide ideas, suggestions, bug reports, and feedback regarding EZ Smart Courses.

We may use such feedback to fix, develop, and improve the product.

Providing feedback does not transfer ownership of unrelated content or intellectual property belonging to the user.

13. Availability and Changes to the System

We may update, improve, modify, add, or remove features of EZ Smart Courses from time to time.

The system operates in an environment that depends on, among other things, WordPress, hosting services, browsers, devices, plugins, APIs, and third-party services. Accordingly, uninterrupted or error-free operation cannot be guaranteed at all times or in every computing environment.

We may perform maintenance and make changes reasonably necessary for security, stability, continued development, or legal compliance.

14. Security

Website owners and users are responsible for taking reasonable security measures in relation to their WordPress website, hosting environment, administrator accounts, passwords, and connected external services.

If a security vulnerability or issue affecting EZ Smart Courses is discovered, it should be reported rather than exploited.

15. Privacy

Use of EZ Smart Courses is also subject to the EZ Smart Courses Privacy Policy, which explains how personal information may be collected, stored, used, and processed in connection with the system.

16. Payments and Transactions on Customer Websites

Where a website owner uses EZ Smart Courses to sell courses, products, subscriptions, or other services, the commercial transaction is between the website owner and the purchaser unless expressly stated otherwise.

The website owner is responsible, among other things, for determining prices, transaction terms, invoices, taxes, cancellation and refund policies, and compliance with applicable consumer protection and other laws.

Where payment is processed through an external payment or clearing provider, use of that service is also subject to the provider's terms.

Purchase, licensing, and payment terms relating to EZ Smart Courses itself, where applicable, may be provided separately through a purchase offer, invoice, agreement, or license.

17. Suspension and Termination of Access

Access to EZ Smart Courses may be restricted or suspended where reasonably necessary because of:

• Violation of these Terms.
• A security risk.
• Illegal activity or suspected fraud.
• Unauthorized access.
• Misuse of the system.
• A legal or regulatory requirement.

A website owner may also separately manage the access of their students and users to courses, communities, and content on their website.

18. Responsibility and Availability of the Service

EZ Smart Courses is provided as a software tool.

Subject to applicable law, we do not guarantee that:

• The system will operate without interruption or error at all times.
• Every feature will be compatible with every WordPress installation, theme, plugin, browser, device, or hosting provider.
• Third-party services and integrations will remain continuously available.
• Content created by users or course providers will be accurate, complete, or suitable for any particular purpose.

Nothing in these Terms limits rights that cannot lawfully be excluded or restricted.

19. Limitation of Liability

To the maximum extent permitted by applicable law, EZ Smart Courses, Shahar Dahan, or “Ezili” will not be liable for indirect or consequential damages arising from the use of or inability to use the software, third-party services, user-generated content, or services independently provided by a website owner.

Nothing in this section limits or excludes liability that cannot lawfully be limited or excluded.

20. Changes to These Terms

We may update these Terms from time to time, including as a result of changes to the system, available features, the service model, or applicable legal requirements.

The date of the latest update will appear at the top of this page.

Where appropriate, notice of material changes may be provided through the website or system.

21. Governing Law and Jurisdiction

These Terms of Use and the use of EZ Smart Courses are governed by the laws of the State of Israel.

In the event of a dispute relating to these Terms or the use of the system, the parties will first act in good faith in an effort to reach an agreed resolution.

If the dispute cannot be resolved by agreement, it will be brought before the competent courts in Israel, subject to applicable law and any jurisdictional rights that cannot lawfully be waived.
